Times News NetworkKanpur: District Consumer Disputes Redressal Commission, Kanpur Nagar, has imposed a penalty of Rs 7 lakh on the operators of Jolly Hospital, a unit of Jolly Nursing Home, for alleged negligence in the treatment of complainant Indra Swarup Awasthi.The commission, comprising chairman Vinod Kumar and members Neelam Yadav and Vandana, delivered an ex parte judgment after the hospital operators failed to appear despite being given repeated opportunities to submit their reply and objections. The commission directed the hospital operators to pay the amount within one-and-a-half months along with Rs 20,000 towards litigation expenses. In case of failure to pay within the stipulated period, interest at the rate of 8% would be payable on the amount.Awasthi, a resident of Etawah Bazar, had filed the complaint before the commission on January 25, 2017. He alleged that he had developed a liver-related problem and medical examination revealed an abscess filled with pus in the right portion of his liver. He was admitted to Jolly Nursing Home on September 1, 2015, for treatment.According to the complaint, Dr Joginder Singh treated Awasthi and removed the pus using a syringe. The complainant alleged that excessive bleeding occurred during the procedure, following which blood was transfused. As his condition deteriorated, he was subsequently shifted to Sanjay Gandhi Postgraduate Institute of Medical Sciences (SGPGI), Lucknow. The hospital had charged him Rs 1.17 lakh for the treatment.The complaint named Dr Joginder Singh of Jolly Nursing Home, his wife Chandani Singh, sons Yuvraj Singh and Yashraj Singh, Shakuntala Devi, Dr Sunil Kumar Soni and Dr Arun Kumar of Gyan Pathology as opposite parties.The commission had issued notices to the hospital operators and directors and provided them sufficient opportunities to present their case, but they failed to appear before the forum.Dr Arun Kumar of Gyan Pathology appeared before the commission and submitted that his role was limited to conducting medical examinations and issuing reports and that he had no role in the treatment of the complainant.………………..
