Prayagraj: The Allahabad HC has deprecated the practice of public employers bypassing regular recruitment by continuously engaging staff through outsourcing agencies, saying this “provides a wide room for exploitation and unfairness”.Allowing a writ petition filed by Kafi Ahmed Khan, who worked as a computer operator on an outsourced basis for over 13 years, Justice Vikram D Chauhan directed the Bareilly Nagar Nigam to consider regularizing his service.In a judgment dated Mar 17, the court observed that prolonged use of outsourced/daily wage labour for core functions can be a sign of exploitation, especially when it replaces regular hiring for sanctioned posts.In 2019, the writ petition for regularization was disposed of by the HC with a direction to the authorities to consider his claim. However, the municipal commissioner turned down his claim in Dec 2020, pointing to a Feb 2016 Govt Order that limited regularization to daily wage workers hired on or before Dec 31, 2001. The court set aside the impugned (under challenge) order passed by the municipal commissioner, Bareilly. It directed that the claim for regularization of the petitioner be considered within four months by the respondents. tnn
