Chennai: Two months after a single judge of Madras high court dismissed a plea moved by TVK founder Vijay, challenging 1.5 crore penalty imposed by the I-T dept, he has moved an appeal against the order.The penalty was imposed for allegedly not disclosing his true income during the assessment period 2015-16.In his writ petition, Vijay challenged the limitation of the notice issued against him under the Income Tax Act. Refusing to entertain the plea on Feb 6, Justice Senthilkumar Ramamoorthy said, “The order imposing penalty was issued within the period of limitation prescribed in Section 275(1)(a) of the I-T Act.”The issue pertains to searches carried out by the dept at Vijay’s residence on Sept 30, 2015. The dept claimed that during the search, undisclosed income earned by the actor to the tune of 15 crore was unearthed.The actor declared an income of 35.42 crore for FY 2015-16. However, the dept claimed he failed to disclose 15 crore income earned through the movie ‘Puli’ released in 2015.Therefore, the dept passed a re-assessment order dated Dec 30, 2017. On verification of the profit and loss account, it was noticed that the actor claimed 2.92 crore as expenditure under the head ‘Release and Rasigar Mandram (fan club) Expenses.’ The claim was rejected and added to his income.
