Srinagar, Aug 8: The Municipal Committee Uri has issued a final public notice warning property owners, builders, contractors and others against carrying out unauthorised construction, deviations from sanctioned building plans and illegal changes in land use within its jurisdiction.
The Executive Officer, Municipal Committee Uri, said no person would be allowed to commence, execute, alter, extend or reconstruct any building or undertake any construction activity without obtaining prior building permission or sanction from the competent authority.
The notice, issued under the provisions of the Jammu and Kashmir Municipal Act, 2000, J&K Unified Building Bye-Laws and other applicable laws, directed residents to obtain building permissions through the prescribed Online Building Permission System (OBPS)/AutoDCR portal along with the required documents, plans and prescribed fee.
The municipal body also cautioned people against approaching brokers, middlemen, touts or other unauthorised persons for obtaining or expediting building permissions.
It said any construction carried out without permission, deviation from sanctioned plans, unauthorised addition of floors, encroachment or structural alteration would be treated as unauthorised construction and invite action under law.
Such action, it said, could include stoppage of work, sealing of premises, demolition or removal of unauthorised structures, recovery of charges and penalties, besides prosecution wherever applicable.
The MC further warned that residential premises could not be converted into commercial, institutional or other uses without obtaining the requisite permission under law. Any unauthorised change of land use would also invite legal action.
It said deviations from sanctioned building plans, including construction of extra floors, projections, balconies, encroachments and violations of prescribed setbacks, would be liable for removal or demolition at the owner’s risk and cost.
The municipal committee has also directed property owners, builders, contractors, architects, engineers and Registered Technical Persons (RTPs) to ensure strict compliance with sanctioned building plans and applicable building bye-laws.
Importantly, the notice warned that any person, including a municipal official, contractor, architect, engineer, broker or consultant, found facilitating or colluding in unauthorised construction or illegal change of land use would be liable for appropriate disciplinary and/or legal action.
The public has been urged to report cases of unauthorised construction, deviations from approved plans, unauthorised commercial use, illegal change of land use, encroachment on public or municipal property, or individuals claiming to secure illegal permissions to the office of the Executive Officer, Municipal Committee Uri.
