Thane: While rejecting a claim, the Motor Accident Claims Tribunal (MACT) held that the deceased was a trespasser who had entered a restricted operational zone without authorisation or safety gear, and was, therefore, responsible for the fatal accident.The MACT in Thane dismissed a Rs 50 lakh compensation plea filed by the family of a 32-year-old dock worker who died after being crushed by a heavy stacker crane in 2019. A copy of the order dated April 8 was made available on Monday.The tribunal observed that although the death was tragic, the claimants failed to establish rash or negligent operation of the crane. It noted that the incident occurred inside a designated “no men zone” at a container freight station (CFS) in Dronagiri, Uran, where entry was strictly prohibited.The tribunal further pointed out that the deceased had ignored visible safety warnings, including instructions to maintain distance from the machine. It also held that crane operators, while handling elevated container stacking, cannot be expected to monitor ground movement continuously.Additionally, the tribunal ruled that the insurer was not liable due to a breach of policy conditions, as the crane operator lacked the required endorsement on his driving licence. It also took note that the premises owner had already paid Rs 31 lakh as full and final settlement to the family.
