Hyderabad: Granting temporary relief to Pradeep Constructions, Telangana high court on Wednesday ordered GHMC not to take any coercive action against the project, BLISS residential project, at Somajiguda till July 23.The civic body had on July 7 issued notices to the developer, stating that the multi-storied buildings of the residential project were constructed in the full tank level (FTL) of Hussainsagar, and obtained permissions by suppressing facts. It proposed to demolish the high-rise.Justice Pulla Karthik, while posting the matter to July 23 for further hearing, also directed respondent authorities to file their counters in the case.Appearing for the firm, senior counsel P Sri Raghuram argued that the GHMC’s notices issued on July 7 proposing to demolish the residential building were illegal, arbitrary, without jurisdiction and based on unverified material, and sought to quash the notice and all connected proceedings in the matter.He also contended that the GHMC issued notices based on the draft FTL, which was yet to be finalised.Senior counsel S Niranjan Reddy, appearing for GHMC, sought time to file counters in the matter, adding that “the building is not under threat since there is already an interim protection in a connected matter”.Meanwhile, resident petitioners in the connected matter also urged the court to direct authorities not to conduct any enquiries in continuation of the showcause notices issued to them.However, HYDRAA standing counsel argued that he was not served with the case papers and sought time, stating that he cannot apprise the court without going through the material.After hearing all sides, the judge directed authorities not to take any coercive action in continuation of the demolition notices till the next date of hearing.
