Kanpur: The National Green Tribunal (NGT), Principal Bench, New Delhi, has asked the Kanpur Nagar Nigam to place on record a certified copy of the final notification of 2016 in a matter relating to the status of a disputed plot in Kanpur.The matter pertains to Original Application No. 1284/2024, Tarun Kumar Jain vs Kanpur Development Authority and others. The matter was heard on Aug 10 by a bench comprising Justice Prakash Shrivastava, chairperson, and Dr Afroz Ahmad, expert member.In the reply filed on March 3, 2025, on behalf of the Kanpur Development Authority (KDA) before the Tribunal, it was stated that the concerned Plot No. 70, Block W-1, Kanpur City had been notified as a park in 2016.According to the KDA’s reply, on Jan 13, 2016, the Kanpur Nagar Nigam had published a proposal under Section 4 of the Uttar Pradesh Parks, Playgrounds and Open Spaces (Preservation and Regulation) Act, 1975, inviting objections from the general public regarding the declaration of various properties as parks and playgrounds. The concerned plot was also included in this list.KDA had further stated that thereafter, on May 29, 2016, a final notification was published by the Kanpur Nagar Nigam, in which the concerned plot was included as a park. According to KDA, if the character of the plot had already been established as that of a park, then its status could not be changed under the provisions of the said Act and it could not be allotted to any other party.However, the Tribunal found that in KDA’s reply, Annexure R1/4 has been described as the final notification dated May 29. 2016, but the document attached on record prima facie appears to be different from that notification.For this reason, during the hearing, the counsel appearing on behalf of the Kanpur Nagar Nigam sought four weeks’ time and requested permission to place on record a copy of the concerned final notification.Accepting this request, the NGT fixed the matter for further hearing on Oct 29, 2026.
