Nagpur: The ban on triple talaq was violated after a 36-year-old man allegedly uttered ‘talaq, talaq, talaq’ three times to his first wife in front of witnesses when she reached his wedding reception venue on Tuesday afternoon.The case has been registered under Muslim Women (Protection of Rights on Marriage) Act, 2019 at Kotwali police station.As per the complaint the woman, a resident of Mahal, married Mobin Ahmed Mohd Rafiq Shaikh on December 7, 2012, as per Muslim customs and their relationship hit rock bottom since 2021. The couple has a nine-year-old son.A matrimonial dispute has been pending in court since 2024. On July 14, the woman received information that her husband was getting married for the second time at a hall at Awasthi Nagar chowk near Gittikhadan. She reached the spot along with her family members around 2pm as the wedding reception was about to begin.When the woman questioned her husband about his second marriage, he allegedly declared triple talaq on the spot, saying “I am divorcing you and you can do whatever you want.”The Muslim Women (Protection of Rights on Marriage) Act, 2019 criminalises the practice of instant triple talaq, making it punishable with up to three years imprisonment and a fine. The law was enacted to protect the rights of Muslim women and prevent arbitrary divorce.Police initiated investigation after the complainant sought justice and protection for herself and her minor son.Senior police officers confirmed that statements of witnesses are being recorded and necessary legal action will be taken, as per provisions of law. The accused is yet to be arrested.
