Noida: The additional sessions court on Monday sentenced a man to three years and eight months in jail and imposed a fine of Rs 4,000 after he pled guilty to attempting to shoot a policeman in 2022.Judge Somprabha Mishra took a lenient view after being informed that the accused, Akash, was in jail for more than three years and during that period his family had come close to starvation as he was the only earning member.“During the arrest, the illegal .315-bore pistol used in the incident, along with two live cartridges, was recovered from him. However, no policeman or other person was injured in the incident. Consequently, the case against the accused under Sections 307/34 IPC (attempted murder with common intent) and 25/27 of the Arms Act (possessing and using an illegal firearm), was proven,” the court ruled.The court awarded three years and eight months’ imprisonment with a Rs 2,000 fine under Section 307/34 of the IPC and three years with a Rs 1,000 fine under each section of the Arms Act while clarifying that all the sentences would run concurrently and be adjusted against the time already spent in custody.The incident dates back to Aug 23, 2022, when a team from the Sector 39 police station intercepted two people in front of the Noida Authority’s under-construction office.Two people, later identified as Akash and Bhura, opened fire on the police in a bid to escape but were soon overpowered and arrested. The pistol and two live cartridges were recovered from Akash. After investigation, his case was separated and police filed two separate chargesheets for offences under the IPC sections and Arms Act.The accused initially sought a trial but later decided to plead guilty and moved an application in this regard.
