Prayagraj: The Allahabad high court has sought an explanation from the additional principal judge, family court, Jhansi, over an order directing a man to pay maintenance to his former wife despite her remarriage after their divorce.Justice Praveen Kumar Giri was hearing a revision petition filed by the man challenging the order of the family court, directing him to pay Rs 10,000 per month as maintenance to his former wife.In its order dated July 7, the high court issued notice to the wife and fixed July 21 as the next date of hearing. The court also directed additional principal judge Harish Chandra to explain why he passed the maintenance order despite the wife’s second marriage having been disclosed in her objection dated Oct 30, 2025.Appearing for the husband, counsel Vatsala submitted that the couple was granted a divorce on July 30, 2025, by the additional principal judge, family court, Jhansi. It was argued that although the man had filed an appeal against the divorce decree, the wife remarried within a month of the decree being passed.“The woman’s second marriage was disclosed by her in an affidavit. However, despite such disclosure, the family court directed the man to pay Rs 10,000 per month to the wife and Rs 5,000 per month to their son. Under the law, a wife is not entitled to maintenance after remarriage,” the husband’s counsel submitted.Under Section 125 of the Code of Criminal Procedure (CrPC), a “wife” includes a woman who has been divorced by, or has obtained a divorce from her husband provided she has not remarried.
