Nagpur: The Nagpur bench of Bombay high court on Friday upheld the police decision refusing permission for a proposed Kanwar Yatra from Kalyaneshwar Shiv Mandir in Mahal to Ganesh-Shiv Mandir in Ansar Nagar, Mominpura, effectively ruling that the procession cannot pass through the locality.A division bench of Justices Anil Kilor and Rajneesh Vyas dismissed the petition filed by organiser Deepak Nechwani seeking permission for the yatra proposed on Aug 16.The petition was heard along with an intervention application filed by Faizan Adil Khan, a resident of Mominpura, who opposed the procession. Khan argued that permitting the yatra could lead to untoward incidents and adversely affect communal harmony in the area. He supported the police’s decision to deny permission on law-and-order grounds.After hearing all parties, the bench declined to interfere with the police’s decision, thereby affirming the refusal of permission for the procession.The proposed Kanwar Yatra was scheduled to begin at Kalyaneshwar Shiv Temple in Mahal and conclude at Ganesh-Shiv Temple in Ansarnagar, Mominpura.Advocates Sahil Mate and Nikhil Waghmare appeared for the petitioner. Govt Pleader and Senior Advocate Deven Chauhan represented the state, while Advocate Ashwin Ingole appeared for the intervenor.
