Mumbai: Bombay High Court on Wednesday questioned how a special court could have framed charges against NCP’s Nawab Malik in a money laundering case when his petition seeking documents from Enforcement Directorate was pending before it.Justice Milind Jadhav was hearing Malik’s challenge to PMLA court’s Sept 25, 2025, order that rejected his application for documents vital for filing for discharge. His advocate said despite ED’s statement, charges were framed in Nov 2025. In Dec 2025, HC granted interim stay on the proceedings and permitted Malik to also challenge framing of charges. “How can the charge also be framed when this thing is pending?” asked Justice Jadhav.The advocate also said ED claimed a fire in its office had affected documents in the case. However, their copies that were part of earlier proceedings could be provided to Malik. Justice Jadhav continued the interim stay till Oct 8 and asked ED to provide details regarding the fire incident.
