Patna: BJP MLA Nitish Mishra filed a plea before the high court on Aug 19, questioning the maintainability of an election petition against him on the ground that it had been filed beyond the stipulated time limit. The court will hear the plea on Sept 16.Mishra is a cabinet minister holding two portfolios in the present NDA govt in Bihar — information technology and urban development & housing.A petition under the Representation of the People Act was filed by Ram Narayan Yadav, a candidate fielded by the CPI, in Jan this year, challenging Mishra’s election from Jhanjharpur assembly seat on the ground of furnishing incorrect information in his nomination papers.On June 24 this year, the election petition was admitted by a single bench of Justice Ashok Kumar Pandey, functioning as an election tribunal under the Representation of the People Act, 1950.
