JAMMU, SEPTEMBER 15: The Jammu and Kashmir Anti-Corruption Bureau (ACB) has registered a case against a former Assistant Commissioner (Revenue), Jammu, and four private beneficiaries over alleged illegal permissions for the alienation and transfer of land recorded as “Gair Mumkin Khad” in Chowadi and Deeli areas of Jammu.
According to the ACB, FIR No. 12/2026 has been registered at Police Station ACB Central, Jammu, against Nisar Ahmad Shad, the then Assistant Commissioner (Revenue), Jammu, and four private individuals.
The case follows the outcome of Preliminary Enquiry No. PE-JSK-17/2019, which allegedly disclosed prima facie evidence of abuse of official position by the then revenue officer.
The ACB alleged that between May 23, 2018 and July 11, 2018, while functioning as Assistant Commissioner (Revenue), Jammu, Shad granted nine permissions for the alienation or transfer of land classified as “Gair Mumkin Khad” in Chowadi and Deeli.
According to the anti-graft agency, the permissions were allegedly granted in violation of applicable revenue laws, government orders and directions of the High Court concerning land falling under the “Gair Mumkin Khad” category. No Record of Claimed DC Approval
The preliminary enquiry also raised questions over the purported approval of the Deputy Commissioner, Jammu, under which the permissions were shown to have been issued.
The ACB said verification with the office of the Deputy Commissioner, Jammu, revealed that no corresponding approval, note sheet or formal delegation order was available on official record.
On the basis of the enquiry findings, the ACB registered the FIR under Section 5(1)(d) read with Section 5(2) of the J&K Prevention of Corruption Act, Svt. 2006, besides Sections 120-B, 467, 468 and 471 of the RPC.
The provisions invoked relate to alleged criminal misconduct, criminal conspiracy, forgery and use of forged documents.
The ACB said that further investigation is in progress to establish the circumstances surrounding the issuance of the permissions and the respective roles of the accused.
The allegations remain subject to investigation, and the guilt or otherwise of the accused will be determined by the competent court in accordance with law.
