Thiruvananthapuram: Special public prosecutor (SPP) appointed by govt in the case related to the alleged attack on Enforcement Directorate (ED) officials after a raid at the residence of opposition leader Pinarayi Vijayan, told the court on Friday that former public prosecutor Geena Kumari had misled the court, resulting in bail being granted to the ninth accused, Harish Kumar.SPP T Santhosh Kumar made the submission before the principal district and sessions court while opposing the bail pleas of the remaining accused, including CPM Palayam local committee secretary I P Binu. Kumar was appointed as SPP after controversy erupted over the stand taken earlier by the former public prosecutor.The court adjourned further hearing on the bail applications to Saturday after the SPP sought time, stating that arguments could be completed only after the court examined the video footage of the alleged attack.Opposing bail, the SPP argued that assaulting govt officials who had come to carry out official duties was a serious offence and could not be treated lightly. He submitted that the investigation should examine whether there was a criminal conspiracy behind the attack and contended that the earlier submission that the investigation was completed was incorrect.The prosecutor also told the court that the alleged offences were grave, and that examination of the accused persons’ mobile phone records was still required. He argued that granting bail at this stage could adversely affect the investigation and said the defence could not seek parity merely because the ninth accused was already granted bail.
