LUCKNOW: A Lucknow court on Wednesday convicted Matloob Alam alias Babu in a 2010 Kanpur Nagar murder case involving a country-made bomb and sentenced him to life imprisonment for murder, besides awarding separate jail terms under the Criminal Law Amendment Act and Explosive Substances Act.The judgment was delivered by ADJ-III special judge NIA Umakant Jindal in a case registered at Babupurwa police station, Kanpur Nagar, under Sections 302 and 504 of the IPC, Section 7 of the Criminal Law Amendment Act and Sections 4 and 5 of the Explosive Substances Act.According to the court record, the case arose from the death of 22-year-old Mohd Ahmad alias Sani. The case was that Matloob Alam attacked him with a country-made bomb following a dispute over money.Senior lawyer MK Singh said the judgment records that on the night of the incident, the victim was near a paan shop in the Begum Purwa area when Matloob Alam allegedly arrived on a motorcycle.The prosecution alleged that an altercation took place after the accused demanded repayment of money.“The court examined the complainant’s account, statements of witnesses, medical evidence, forensic reports and other material collected during the investigation. The case was that Matloob threw a bomb at the victim with the intention of killing him. The explosion caused serious injuries to the victim, including severe injuries to his head, resulting in his death,” said Singh.The court noted that the medical evidence was consistent with injuries caused by the blast. A doctor who examined the accused after the incident also recorded blast injuries to his left hand, with treatment continuing for several days.One of the significant pieces of evidence considered by the court was a severed finger recovered from the spot.The judgment records that the accused himself suffered a hand injury during the blast and that one of his fingers was severed. Police recovered the severed finger from the scene.The forensic examination later compared the blood sample from the severed finger with the accused’s blood sample. The court noted that DNA examination established that the severed finger belonged to Matloob Alam.The court also considered forensic examination of remnants of the bomb recovered from the spot. The forensic report found explosive substances, including potassium chlorate, sulphur, nitrate and charcoal, among the material recovered from the scene.The court examined the post-mortem findings and medical testimony concerning the victim. The post-mortem report recorded multiple injuries, including a serious injury to the head attributed to the blast.The court observed that the medical evidence supported the prosecution’s account that the victim died from injuries sustained in the explosion.After examining the evidence, the court concluded that the prosecution had established the charges against Matloob Alam beyond reasonable doubt.The judgment particularly relied on the combination of eyewitness accounts, medical evidence, forensic examination of explosive material and DNA evidence relating to the severed finger.
