Hyderabad: A villa owner in a gated community near Kompally has approached police alleging that her property was illegally mortgaged by the builder in Oct 2025 to a corporate firm by showing it as unsold property. Based on her complaint, Medchal police have registered a case against the real estate company that developed the project and the private firm that provided loan on the alleged illegal mortgage.The complainant also alleged that the builder has mortgaged several other properties in the ventures developed by them, including a senior citizen’s specific venture, in the same mortgage deed and obtained loans in 2025.The complainant, Anitha Vittal, a senior corporate executive, came to know about the fraud when she recently tried to check encumberance of her property and realised that it was mortgaged without her knowledge.“While obtaining the Encumbrance Certificate (EC) for my villa, I came across a memorandum of deposit of title deeds dated Oct 16, 2025, in which the builder mortgaged my villa in favour of a private company. Upon verification, I found that my villa, along with other properties, was mortgaged without our knowledge,” Anitha alleged in her police complaint.“I request that appropriate legal action be taken against the persons responsible for cheating and fraudulently mortgaging my villa and other properties,” Anitha requested police.Talking to TOI, the complainant said that she had purchased the villa and got it registered in her name at the Medchal sub-registrar office on Aug 24, 2020. “We also received no dues from the accused company that has built the property on Nov 6, 2020. But while fraudulently mortgaging my villa, they have cited it as unsold property in the memorandum of deposit of title deeds registered before the Medchal sub-registrar to avail crores of rupees of loan,” Anitha said.Based on her complaint, Medchal police registered a case under Sections 316(2) (Punishment for criminal breach of trust), 318(4) (cheating and dishonestly inducing delivery of property), r/w 3(5) (common intention) of the Bharatiya Nyaya Sanhita (BNS) on May 5 against the real estate company that has developed the project and the private firm that provided the loan on the alleged illegal mortgage.Medchal police said: “So far, two property owners have approached us alleging that the builder has illegally mortgaged their properties and obtained loan without their knowledge or consent. “On the complaint of one of them, we have registered a case against the two companies involved. We issued notices to both the companies and we are yet to receive a response from them,” Medchal inspector A Satyanarayana said.
