Jaipur: Rajasthan High Court has directed a petitioner challenging the recruitment process to deposit Rs 1 lakh with Rajasthan Public Service Commission (RPSC) through a demand draft, observing that he had been described as a “habitual/compulsive litigant” who had made “ill-founded allegations”.The court said the deposit was required to substantiate his bona fides, while making its forfeiture or refund subject to the final outcome of the petition.The direction was passed by Justice Sameer Jain on Aug 18 — the copy of the order was uploaded Sunday — while hearing a batch of connected writ petitions concerning the recruitment process.The court was hearing a petition filed by Mukesh Shrimal and others. The recruitment was for lecturer posts in the Ayurveda department, specifically in Ajmer Govt Ayurvedic College and associated hospital. The recruitment was conducted by RPSC and the petitioner challenged the selection process, alleging irregularities in the interview/selection procedure.During the hearing, counsel for RPSC, Siddhartha Jain Samant, submitted that allegations concerning a particular expert were under evaluation at the competent level.In Shrimal’s case, RPSC submitted that the petitioner had filed more than a dozen petitions between 2015 and 2023. “He had participated in the examination and therefore the doctrine of acquiescence should apply. Also, the allegations were ill-founded and there was no nexus between successful candidates and the person who conducted the interviews,” Jain argued.In the connected petition, RPSC submitted that the waiting list could not be operated despite a successful candidate having left the job. However, petitioner’s counsel R A Katta alleged that there was malice against the interviewers and that a biased practice had been adopted, rendering the entire process flawed.In Shrimal’s case, the court directed the petitioner to deposit the amount and listed all three matters for Sept 22 in the supplementary cause list.The officer in charge was directed to remain present with records on the next date.
