NCLT appoints two-member committee to address grievances of Jaypee Infratech allottees

NEW DELHI: The National Company Law Tribunal (NCLT)- Delhi has ordered appointment of an independent committee of experts to look into the grievances of the allottees of the Jaypee Infratech projects, which are now being developed by Suraksha Realty.

The order was passed on February 12, 2026.

The applications, filed by Ashwarya Sinha and Aditya Malhotra, advocates for the homebuyers, highlighted inordinate delays and lack of clarity on construction timelines, as well as the levy of arbitrary and compounding interest and other financial demands on the home buyers.

As per the resolution plan approved by the committee of creditors, an independent monitoring committee (IMC) was contemplated but was eventually dissolved in May 2024. According to the applications, the IMC was dissolved without prior notice to the concerned stakeholders.

After hearing all sides, the court ordered that an independent committee of experts should be appointed to safeguard allottees interests and to ensure that their grievances are effectively addressed.

“…we are inclined to appoint former members of NCLT P.K. Mohanty and Dr. Deepti Mukesh to undertake an exercise to assess the progress of construction of the projects in relation to the approved resolution plan dated 07.03.2023 and give a complete comprehensive report on the status and grievance, if any. A honorarium of Rs. 2,50,000/- is to be paid per month to each of the Members until further orders to be passed based on the report,” said the bench in its order.

The expert committee comprising of two members will look into issues concerning homebuyers, status of construction, possession and handover of flats/units, among others.

“The appointment of an expert committee specifically tasked with examining and resolving homebuyer grievances is expected to provide a mechanism for timely redressal and closer scrutiny of the Suraksha Realty‘s conduct going forward,” said Sinha.

The matter has been listed on April 1, 2026 for further consideration.
