Nagpur: A court on Friday granted four-day police custody to accused Mujammil Ali, after his school marksheet proved he was proficient in Marathi and fully understood the grounds of his arrest, unlike what he earlier told the judge.The accused was again produced in court, where the investigating officer sought police custody remand for further probe. The defence strongly objected, claiming the re-arrest was illegal as the accused had been released by court on June 10. They argued that rearrest in the same case without fresh permission was not permissible.Prosecutors countered that no bail bond or personal bond was executed on June 10, hence the release did not amount to formal bail under Bharatiya Nagarik Suraksha Sanhita (BNSS). The court accepted this position after detailed examination.The magistrate noted the earlier release order was passed because the accused claimed he did not understand Marathi and the ground for arrest was not properly explained in a language he knew.However, the investigating team presented the accused’s school records and marksheet in court, which clearly showed he studied Marathi as a subject and secured marks in it. This evidence demolished the defence’s claim and established that the accused fully understood the Marathi arrest memo.The court observed that the previous order was based on incorrect facts. The judge held that since no bail bond was executed, the subsequent arrest was legally valid.Citing the gravity of the murder case and the need for thorough investigation, including recovery of the mobile phone, weapons, and other crucial evidence, the court granted police custody remand till June 16.
