Apple and OpenAI have proposed competing schedules for document production, discovery and pretrial proceedings in Apple’s trade secrets lawsuit against OpenAI and other defendants, with both sides proposing a trial date of July 19, 2027.

In a joint submission filed on October 23 before the US District Court for the Northern District of California, Apple said OpenAI’s proposed schedule was unrealistic, arguing that the defendants had yet to produce documents and had not adequately complied with discovery requirements.

Apple said the corporate defendants had not produced a single document to it and had limited their responses to initial discovery requests largely to objections. It also alleged that the forensic images submitted by the defendants did not comply with a court order on expedited discovery.

Apple opposed the defendants’ proposed November 30, 2026, deadline for the final identification of trade secrets, arguing that it had already provided a detailed, 147-page preliminary identification. It said the identification of trade secrets was an iterative process requiring engagement between the parties.

The defendants, in their submission, argued that Apple’s proposed schedule left insufficient time for the court to decide dispositive and Daubert motions before trial. They also sought a deadline for Apple’s final identification of its alleged trade secrets, arguing that the scope of the claims should be sufficiently defined to allow them to prepare their defence.

Under Apple’s proposed schedule, substantial completion of document production would be due by February 19, 2027, and fact discovery would close on April 9, 2027. The defendants proposed earlier deadlines of January 15, 2027, for substantial completion of document production and February 19, 2027, for the close of fact discovery.

Both sides have proposed July 19, 2027, as the trial date. The competing schedules have been submitted to US District Judge Edward J. Davila for consideration.
