Srinagar, Sep 21: The Jammu and Kashmir government on Monday dismissed a school teacher from service with immediate effect in connection with a case registered under the Bharatiya Nyaya Sanhita and the Protection of Children from Sexual Offences Act, 2012.
The action was taken against Khalid Hussain, Teacher Grade II, Government Middle School, Bumalpora, Gurinalla, Zone Inderwal, District Kishtwar.
According to a Government Order No. 388-JK(Edu) of 2026, issued on September 21, Hussain was already under suspension and in judicial custody in connection with FIR No. 34/2026 registered at Police Station Chatroo.
The FIR was registered under Sections 61(2), 65(1), 90, 91 and 92 of the Bharatiya Nyaya Sanhita, 2023, and Sections 4, 6, 8, 10 and 17 of the POCSO Act, 2012.
The competent authority considered the facts and circumstances of the case and concluded that the activities attributed to the teacher warranted the major penalty of dismissal from service, the order states.
The government invoked sub-clause (b) of the proviso to clause (2) of Article 311 of the Constitution of India, read with Rule 30(viii) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956.
As per the order, a regular departmental inquiry was not reasonably practicable in the circumstances of the case. It also stated that his continued employment would be detrimental to the interests of the Government and could erode public trust in government institutions.
With the dismissal, Hussain has also been disqualified from future employment in the government service of the Union Territory of J&K.
The order was issued by the School Education Department on the directions of the Government of Jammu and Kashmir and signed by Ram Niwas Sharma, Commissioner/Secretary to the Government, School Education Department. The order bears No. 388-JK(Edu) of 2026 and is dated September 21, 2026.
In a separate press release, the School Education Department said the dismissal had taken immediate effect. It said the teacher was already under suspension and in judicial custody in connection with the case.
The department said the criminal investigation and trial were being pursued by the concerned law enforcement authorities in accordance with law. It also reiterated the Government’s commitment to child safety and protection and to strict accountability of school staff.
No further details identifying the victim, school or location would be disclosed, citing the confidentiality requirements under Section 23 of the POCSO Act, 2012, the department said.
