Gurgaon: Residents of a society in Sector 45 have alleged that the town planner proceeded to demolish a toe wall despite being aware of a pending civil suit challenging the proposed action.The dispute centres on the toe wall between Greenwood City’s Block A and HSVP colony in the same sector. A toe wall is a low retaining structure constructed at the base of an embankment, slope, or larger retaining wall to stabilise soil and minimise erosion.In a letter — dated Aug 27 and addressed to district town planner (enforcement) — Greenwood City ‘A’ Block Residents Welfare Association said it had already approached the civil court against the proposed demolition and that the proceedings were pending adjudication. The association alleged that the department had been actively contesting the matter.The RWA said the department had initially filed a written statement in the civil suit containing “various blanks” and subsequently moved an application seeking its amendment.The association said this demonstrated that the department was “conscious” of the dispute. The residents said an official arrived at the site on Aug 26 along with around 50-60 police personnel and proceeded to demolish the wall.RWA alleged that when its members asked the officials to disclose the authority and basis for the action, the said official stated that an order had been passed by deputy commissioner, directing the demolition. However, “no copy” of the purported order was shown or supplied at the site.RWA has now sought an immediate copy of any order or direction issued by DC authorising or directing the department to demolish the boundary wall.The letter describes the demand for the order as “most urgent” and states that it has been issued without prejudice to the association’s other rights.The association’s communication does not, however, provide details of the underlying ownership or planning dispute, nor does it reproduce any order passed by the civil court.RWA has specifically sought documentary confirmation of the alleged DC direction, leaving the legal and administrative basis for the demolition to be clarified by the authorities.The twon planner couldn’t be contacted.
