Patna: A Patna court on Monday reserved its order on the bail plea of Janshakti Janata Dal (JJD) national president Tej Pratap Yadav, who was arrested in connection with the violence that broke out during the Bihar bandh on July 25.The bail application was heard by Divisional Magistrate Aarti Upadhyay, where both the defence and prosecution presented their arguments. After hearing both sides, the court reserved its order. Tej Pratap continues to remain in 14-day judicial custody at Beur Central Jail.During the hearing, Tej Pratap’s counsel, advocate Nisha Singh, sought his release on bail, citing his health condition and questioning the legality of the police action. She submitted that Yadav suffers from diabetes and high blood pressure and had complained of chest pain after being admitted to Beur Central Jail, following which he was placed under medical observation.The defence also questioned the arrest procedure, claiming that Tej Pratap was taken into custody before the FIR was registered. According to the lawyer, he was detained at around 7.15pm on July 25, while the FIR at Gandhi Maidan police station was lodged at around 12.50am the following day. She argued that this raised serious concerns over whether due legal procedure had been followed.Advocate further contended that stringent charges, including the attempt to murder provision, had been invoked without sufficient basis and did not correspond to the facts of the case.Opposing the plea, the prosecution argued that the allegations against Tej Pratap were serious and that he should not be granted bail.Talking to TOI, advocate Singh clarified that the court had not rejected the bail application. “The hearing has concluded and the court has reserved its order. Until we receive the official order sheet, it would not be appropriate to say anything further. Without the order sheet, no information can be treated as authenticated. Once the order is reserved, there is no question of a next hearing date. The court will directly pronounce its order,” she said.The Gandhi Maidan police have booked Tej Pratap Yadav under various provisions related to rioting, assault on police personnel, damage to govt property, obstructing public servants from discharging their duties and causing injuries to the Gandhi Maidan police station SHO during the July 25 Bihar bandh violence.
