Kolkata: The Calcutta High Court on Tuesday directed the human rights commission to file a report on alleged custodial torture of an accused, who was sent to three-day custody at Bolpur Police Station. The court also questioned whether an allegation against a junior could be fairly investigated by a senior of the same organisation.According to the allegation, last Tuesday, the additional superintendent of police, Birbhum, had summoned Amir Sohel Mondal alias Ripon, arrested on Sept 21 and he was tortured in the chamber of the inspector-in-charge of the Bolpur Police Station. Following a complaint, the magistrate directed the superintendent of police, Birbhum, to investigate the allegation and submit a report within 30 days. The single judge, Justice Krishna Rao, asked the Centre’s lawyer: “If there are allegations against your chamber junior and the court appointed you to inquire, what report will you file?” “In 30 days, all things will go… you know how the police act,” he said.Justice Rao on Tuesday ordered a report from the human rights commission as well as the SP on the victim’s injury. The state was directed to preserve the CCTV footage of the entire Bolpur Police Station, including the office of the IC, from Sept 21 to 23.Amir’s counsel, senior advocate Kishore Datta, submitted that around 11 am on Sept 22, the additional SP of Birbhum summoned Amir and a co-accused. “I was assaulted in the Bolpur Police Station IC’s chamber. I suffered various injuries, including dislocation of my shoulder and hand joint. I have bruises on my body. Bare minimum medical treatment was not given to me. Primary care was given, which according to me is insufficient,” Datta submitted on Amir’s behalf. He prayed for the human rights commission to take cognisance of the matter and provide treatment to Amir.“Every 24 hours, you are to bring the person in police custody to the hospital and obtain the report. Let the medical report and CCTV footage be preserved,” Justice Rao said.The PP said when he was presented before the magistrate, the SP was directed to SP to probe and submit a report. .
