Panaji: A Mapusa court adjourned the pronouncement of its order in the bail applications of Gaurav and Saurabh Luthra to Feb 12 in the Birch by Romeo Lane nightclub fire. This is the second time the bail order was deferred/adjourned in their case.The court, on Jan 28, reserved its orders for Feb 5 and then adjourned it to Feb 10.
Ajay Gupta, co-owner of the club, who was granted bail in the forgery case last week, also applied for bail in the fire case. His bail matter will come up for hearing on Feb 16.The Luthras told the court that culpable homicide not amounting to murder does not apply to them in the case. The brothers submitted before the court that they were in Delhi when the fire took place, and therefore there was no act committed by them to cause the deaths, and that whoever was handling the club could have acted to prevent the fire. At the most, it could be a case of causing death by negligence, their advocate said.The prosecution, opposing their bail applications, told the court that the investigation is ongoing and that new facts emerged after the interrogation of the disqualified sarpanch Roshan Redkar and dismissed secretary Raghuvir Bagkar, which require further investigation. The prosecution also said the allegations against the Luthras are serious.
