Surat: A additional sessions judge rejected Poonam Bhadauria’s regular bail application in the case pertaining to builder Tushar Ghelani’s suicide. Bhadauria had been arrested after Ghelani’s daughter, Tanvi, filed a suicide abetment and extortion complaint against her. Tanvi alleged the accused was in an illicit relationship with her father and had blackmailed him to extort money.In her bail application, Bhadauria’s advocate argued that if Ghelani was in stress due to the relationship, why he did not complain about it to his family or the police. The advocate contended that the allegations were fabricated and without evidence. The complainant had purportedly fought with her father after she returned to Surat after her studies abroad. Ghelani was happy until the evening of his daughter’s wedding, and there was no chat or suicide note that pointed to the role of the accused. Bhadauria’s role in Blue Papillon School since 2015 was not known to the family. Ghelani voluntarily gave properties to Bhadauria, the lawyer contended.Bhadauria also objected to the delayed complaint and raised doubts about whether Ghelani’s death was suicide, as he shot himself with his right hand while he was left-handed.Advocate Kalpesh Desai filed an affidavit on behalf of Tanvi Ghelani. Referring to it, public prosecutor Nayan Sukhadwala opposed bail and contended that the complaint was delayed as the complainant was to be married. Ghelani and the accused were friends, and when friendship turned into extortion, it became a very serious matter. When anyone is threatened at the time of a daughter’s wedding, he is definitely under pressure. The accused took a partnership in the school and got two shops in her name. Bhadauria’s sister also did not cooperate with police, as she was the prime witness.After hearing the parties, the court observed: “Various verdicts of the Supreme Court and High Court for quashing and bail cannot be considered for this case as the probe is still going on. When a father dies by suicide at the time of a daughter’s marriage, the seriousness of the crime increases. As the probe is on in this case, the deep evaluation of evidence is not appropriate at this time for the bail application. The accused also raised the question about Ghelani being left-handed and had shot himself with his right hand. Thus, a detailed probe is needed. Primarily, it seems that the accused is involved in the crime. So, if she was released on bail, she may disturb the probe and threaten the complainant and witnesses. So, her regular bail application is rejected in the interest of justice.”
