A three-member bench headed by Chief Justice of India Surya Kant took note of the submissions of the lawyer appearing for DMK’s organising secretary R S Bharathi and ruled that the petitions do not require adjudication in view of the apex court judgement on petitions challenging the SIR exercise in Bihar. The bench then closed proceedings in all the 13 petitions challenging the SIR in the state.

In May, a bench headed by CJI Kant had delivered its judgment on a batch of petitions challenging SIR in Bihar and upheld Election Commission’s power to conduct the exercise by the poll panel.
It said the exercise “breathes life” into the constitutional mandate for fair elections and advanced the “constitutional imperative of free and fair elections.” The top court had ruled that SIR bears a direct nexus to the Constitutional goal of free and fair elections.
