Bengaluru: Karnataka high court recently quashed an FIR against a man accused of sexually harassing a woman after she came across him answering nature’s call near a railway track. The woman had alleged that the man exposed his private parts and made inappropriate gestures at her. The court, however, found that the gesture was a reaction to the shock of realising that the woman had seen him urinating.According to the petition, the man had got off a bus and was looking for a public toilet. Unable to find one, he walked to a nearby railway track to answer nature’s call. While he was urinating, the complainant happened to enter the area. On noticing her, he reacted, following which she later filed a complaint alleging he had made lewd gestures at her.Justice M Nagaprasanna examined the evidence and found that the man had no wilful intention to make a lewd gesture. “In the considered view of this court, answering nature’s call and coming in front of the complainant, at that point in time, would not become an ingredient of outraging the modesty of a woman,” the court said.
