Nagpur: The Nagpur Municipal Corporation (NMC) on Wednesday told the Nagpur Bench of the Bombay high court that demolition of an alleged illegal construction linked to an accused in the Mahal riots case was carried out strictly in accordance with law. Notices were duly served through Speed Post and on-site affixture under the provisions of the Maharashtra Regional and Town Planning (MRTP) Act, 1966, the civic body claimed.NMC counsel Gemini Kasat also submitted postal records and a panchnama regarding service of notice.The matter came up before a division bench comprising Justices Anil Kilor and Raj Wakode in a petition filed by Aziza Begum Sheikh Salim, a relative of a co-accused in the riots case, through counsel Ashwin Ingole.The petition challenges the proposed and subsequent action initiated by NMC under the provisions of the MRTP Act.NMC stated that a notice under Section 53(1) of the MRTP Act was issued on March 23, 2025, and the notice was affixed on the disputed structure on March 24, 2025.As per NMC, an inspection conducted on March 20, 2025, revealed that an unauthorised construction measuring approximately 30 square metres was done on the first floor without permission.NMC issued a notice directing removal of the illegal construction within 24 hours and warned that failure to comply would invite demolition action along with possible criminal proceedings.The civic body informed that since the unauthorised structure was not removed by the occupants, demolition action was initiated on March 24, 2025.Through the documents submitted before the bench, the civic body sought to establish that the entire process was carried out in compliance with statutory procedure.
