Pune: A Motor Accident Claims Tribunal (MACT) of Pune district has granted Rs 14.02 lakh compensation with an interest of 7% per annum to a job inspector (35) with an engineering firm who lost his right leg in a road accident on Jan 17, 2018.The tribunal held that the inspector did not suffer any loss of future income as he continued in service with increased salary, even though he had sought Rs 50 lakh compensation.The accident took place on the Mumbai-Bangalore highway near Mhalunge, when a concrete mixer vehicle hit the claimant’s motorcycle from behind. The accident caused him to fall, and the vehicle’s wheel ran over his leg, resulting in grievous injuries and amputation from above the knee.The claimant was working as a job inspector with an engineering company at the time of the accident and was earning around Rs 26,500 per month. He remained off duty for nearly a year following the incident. Evidence on record showed that he continued to be employed with the same company, with his salary increasing to over Rs 41,000 in subsequent years.Relying on police records and medical evidence, the tribunal held the driver of the concrete mixer solely negligent and rejected the insurer’s contention of contributory negligence.The tribunal noted that the claimant had suffered permanent disability, but declined claims towards future artificial limb expenses and excessive conveyance costs due to lack of supporting evidence.
