KANPUR: Hearing the muchpublicised Lamborghini car crash case, additional chief judicial magistrate (VII), Kanpur Nagar, Amit Singh, on Wednesday dismissed the surrender application of Shivam Mishra’s driver, saying the tobacco baron’s son is the accused as per the police investigation report.The ACJM (VII) said that since the name of Shivam’s driver, Mohan Lal, isn’t mentioned anywhere in the FIR, his application would not be accepted, and the car would remain at the police station.

“The applicant was neither named in FIR, nor his name cropped up in the police investigation. Therefore, his application has no merit and is liable to be dismissed,” he said.Two petitions were filed in the court of ACJM (VII) on Tuesday, with the driver applying for judicial custody and the car owner seeking the release of the Rs 10 crore car.The prosecution, led by district govt counsel (criminal) Dilip Awasthi and public prosecutor Nagendra Kumar Mishra, opposed the driver’s bail application, stating Mohan Lal wasn’t named in the FIR and wasn’t found to be the accused during the investigation.The court also denied the request to release the accident-involved car, citing the police report. Public prosecutor Mishra stated that the police had registered an FIR alleging the car caused injuries and that evidence suggested Shivam was driving. The public prosecutor also urged the court to direct Shivam to cooperate with the investigation and provide relevant documents, as he’s not cooperating with the technical examination of the high-end car.While holding the vehicle release application, the court directed Shivam to cooperate fully with the investigation and provide all necessary documents to the police to facilitate the technical examination of the car in accordance with the law. The court observed that the application would be considered only after the technical examination report was submitted.The ACJM also directed the police to complete the technical examination of the vehicle and submit the report before the court on Friday.Earlier, Shivam’s lawyer Narendra Kumar Yadav stated that the injured party, Mohd Tausif, has settled with the driver and identified Mohan as the one driving the vehicle. He said Tausif has also stated that he doesn’t want to pursue the case further.
