Bengaluru: Karnataka high court Tuesday stayed investigations against a Bengaluru doctor in alleged case of assaulting and harassing a couple claiming they were illegal immigrants from Bangladesh, while pulling up cops for rushing into registering a complaint without doing enough homework.Dr Nagendra, who runs a clinic in Bettadasapura-Bellandur, had challenged two FIRs registered against him in Ballandur and Varthur police station over the incident.Granting relief, Justice M Nagaprasanna noted in his order that there’s no better illustration of the abuse of the process of law by cops and it’s time the system stopped supporting illegal immigrants by registering crimes against persons of the city who had identified such people as illegal immigrants. He posted the case to Aug 6.The court asked the state public prosecutor to detail how a case was registered without any examination and how was the petitioner taken into custody based on a complaint which is “apparently false, albeit prima facie”. The Foreigners Regional Registration Office (FRRO) must be a respondent in the case, it added.The court said that a case of assault against the doctor was booked at 11.45pm on July 22, barely 15 minutes after an investigating officer informed the FRRO that the couple was illegally staying in Bengaluru and they should be shifted to a detention centre.“The state must tackle mushrooming of illegal immigration and take action in accordance with law. (While the state is not doing that), a citizen identifies illegal immigrants in the city, and the illegal immigrants are registering crimes against those persons identifying them,” the court said.
