New Delhi: Malaysia’s IHH Healthcare disclosed on Thursday that the Tokyo District Court has dismissed all damage claims filed by its subsidiary Northern TK Venture against Japan’s Daiichi Sankyo and has directed NTK to bear the costs of the litigation.
“On 10 September 2026, the Court has decided that all of NTK’s claims are dismissed and NTK shall bear the costs of the litigation,” IHH informed the Malaysian stock exchange.
IHH is the parent company of India’s Fortis Healthcare Limited.
NTK, a subsidiary of IHH Healthcare Berhad had earlier filed a claim at the Tokyo District Court seeking damages from Daiichi Sankyo, alleging that the Japanese firm had obstructed NTK’s efforts to complete its open offers to acquire shares in Fortis Healthcare Limited and its step-down subsidiary, Fortis Malar Hospitals Limited.
In May last year, NTK amended its damages claim and increased it approximately tenfold from an initial JPY 20 billion to approximately JPY 200 billion, one of the largest damages claims.
The Tokyo court had concluded all preparatory and oral proceedings before pronouncing its judgment on September 10.
In its stock exchange disclosure, the company said it respectfully disagrees with the court’s decision.
“NTK respectfully disagrees with the Court’s decision and maintains firm confidence in the merits of its position. NTK is reviewing the judgment in detail with its legal counsel and is evaluating all legal remedies to pursue the relief it believes is warranted. NTK remains committed to vigorously protecting its rights and interests through every appropriate legal channel,” it said.
The dismissal of NTK’s claims comes just days after the Delhi High Court delivered its landmark 213-page judgment in the Daiichi Sankyo enforcement case ordering a comprehensive court-monitored forensic audit into the dissipation of the Singh brothers’ shareholding in Fortis Healthcare, casting a cloud over IHH’s acquisition of the hospital chain.
IHH operates hospitals across Malaysia, Singapore, India, and Turkey under brands including Parkway and Pantai.
In November 2025, IHH announced the completion of the open offers.
The company said it will make further announcements to the stock exchange in the event of any material developments in the matter.
