Nagpur: The Nagpur bench of the Bombay High Court has termed a petition filed by the Cockroach Janta Party (CJP) challenging the denial of permission for a protest at Samvidhan Square infructuous, directing petitioner Durgesh Kuhike to file a fresh petition because the scheduled demonstration date had already passed.Kuhike, a core member of CJP’s Nagpur wing, had challenged the Sitabuldi police’s decision to deny permission for a peaceful demonstration on Oct 11 from noon to 4 pm. The protest was planned to demand the resignation of the Chief Election Commissioner, Gyanesh Kumar, with an estimated participation of 400 to 500 people. The police denied permission on Oct 10.According to the petition, protesters held a two-hour demonstration on the same demand peacefully in Nagpur on Oct 4. Kuhike’s petition, represented by Pradeep Wathore, argued that the refusal to permit the subsequent protest was unjustified. The police order cited protests in Delhi, the earlier demonstration, the sensitive nature of Samvidhan Square and the Navratri festival as reasons for denying permission. The petition also questioned the failure to cite specific legal provisions supporting the decision. The petition had sought directions to allow the demonstration and prevent police from obstructing or detaining participants. However, with the proposed protest date having passed, the court termed the petition infructuous and directed him to approach it through a fresh petition.
