Panaji: A North Goa court has rejected the application of a father seeking custody of his child during the short summer break in March. The court rejected his application for overnight custody after considering that the child expressed her unwillingness to be with the father.“There is no dispute that the welfare of the child is of paramount importance. Considering the same and the fact that the child has clearly expressed her unwillingness to be with the father and also that the child is a girl, I am not inclined to grant overnight custody to the father for the short summer break as prayed for,” the court stated. The court also observed that visitation rights cannot be given to him, considering the child is occupied with other classes, etc. and that the duration of the March holidays is short. The mother stated the child could meet her father during the summer vacation in May in her presence. The court stated that this may be considered in May.
