Kanpur: An additional sessions court in Kanpur on Tuesday sentenced a woman to eight years’ rigorous imprisonment for culpable homicide not amounting to murder in the death of her husband.Additional sessions judge Abhay Prakash Narayan convicted Monika under Sections 304 (Part II) and 201 IPC and imposed a fine of Rs 11,000.According to the prosecution, Monika’s husband Umesh Kumar Yadav, an ambulance driver, went missing from his Bidhanu home in February 2023. Family members later found his body partially buried beneath the floor of a room with an angaucha tied around his neck.The complainant, Umesh’s father Mathura Prasad, alleged that frequent quarrels took place between the couple over Umesh’s drinking habits.During the trial, the defence argued that Umesh assaulted Monika while intoxicated and died during a scuffle in an act of self-defence. The court observed that the prosecution failed to establish motive or intention to commit murder and held that the case amounted to culpable homicide not amounting to murder.The court also sentenced Monika to two years’ RI for destruction of evidence. Both sentences will run concurrently.
