The Apex Court has dismissed a Civil Appeal filed by Terra Realcon Private Ltd. against the orders of the National Consumer Disputes Redressal Commission (NCDRC). The ruling solidifies the financial protections afforded to homebuyers and underscores the accountability of developers in fulfilling their contractual obligations.
The matter arose from an appeal against the NCDRC’s judgments dated 09.09.2025, and 10.11.2025. The appellant, Terra Realcon, sought to challenge the relief granted to the respondents, Manmohan Bahel and others.
The Bench, comprising Hon’ble Mr. Justice Sanjay Kumar and Hon’ble Mr. Justice K. Vinod Chandran, while condoning the delay in filing the appeal, stated clearly that they found “no good ground and reason to interfere” with the findings of the NCDRC.
The respondents were represented by the prominent legal firm Prasad and Sinha, Advocates. The defense, led by the experienced duo of Anurag Abhishek and Deepa Sinha, was instrumental in securing this favorable outcome.

The Supreme Court’s order has laid out a clear roadmap for the disbursement of funds. 50% of the amount due, which had already been deposited with the Registry of the Court, is to be released to the respondents immediately following due procedure. The appellant, Terra Realcon, has been directed to deposit the remaining 50% balance, inclusive of interest, before the NCDRC on or before 31.05.2026.
The Court ordered that these funds be disbursed by the NCDRC as and when deposited, effectively concluding the litigation for the respondents.
