Mumbai: Observing that the available material was sufficient to proceed against the accused for the framing of charges, the sessions court on Thursday rejected the discharge plea of two brothers accused of assaulting medical staff at Sion Hospital following the death of their father.The accused, Roshan Gupta and Rajesh Gupta, sought to be cleared of charges arising from an incident on June 26 2021, where they allegedly obstructed public servants from performing their duties in the hospital’s emergency ward. Dr Rahul Dhadse was on duty when the father was admitted.According to the complaint, a commotion broke out among the patient’s relatives around 11 pm. When Dr Dhadse attempted to provide medical treatment, the patient died, leading the 2 brothers to allegedly initiate a physical confrontation.The medical officer claimed the men grabbed his collar, slapped him, and tore his shirt, while also pushing another doctor who attempted to intervene.Concluding that the interests of justice required the trial to move forward, the Judge said, “Considering the material, and having heard both the sides, it would be just and proper to negate the said application.”
