Lucknow: The high court has refused to extend the interim order issued in the dispute over the proposed construction of a flyover on La Martiniere College land. The court had on March 10 temporarily restrained the LDA from carrying out any construction on the college’s land. The court passed this order because the LDA’s lawyer had informed it that no construction would be carried out without the permission of the college’s trustees.A bench of Justice Rajesh Singh Chauhan and Justice Indrajeet Shukla passed the order on the writ petition filed by La Martiniere College.When the hearing in the case continued on Monday, the court found that the LDA had not given any such instructions to its lawyer that no construction would be carried out without the trustees’ permission. Taking a serious view of the matter, the court hence refused to extend the interim order.The court also granted time to the parties of the case to file their affidavits. The court has scheduled the next hearing for March 25.Senior advocate JN Mathur, representing the petitioner, had argued that the land on which the construction was being carried out belonged to the Lucknow Martin Charities Trust. He argued that even the trustees of the trust were not competent to transfer the land and that construction without acquisition was completely illegal.In course of hearing, the state government and the LDA stated that the college trustee’s previous meeting scheduled for March 11 could not be held because the principal had postponed it. It was stated that the next meeting would be held on March 18.Considering it, the court directed that the result of the proposed trustee meeting be placed on record before it .
