Lucknow: A Lucknow bench of Allahabad high court has summoned Lucknow DM Vishak G on Tuesday amid the allegation is that govt is trying to acquire land belonging to La Martiniere College for development work without following the due process. The court had ordered the measurement of the land in question and due to non-compliance the above order has been issued. This order was passed by a bench of Justice Alok Mathur and Justice Amitabh Kumar Rai on a petition filed by La Martiniere College. The petition stated that the college owns land at Kothi Martin Sahib, Ganeshganj Station, where govt plans to construct a road and a flyover as part of the Green Corridor project. The college claimed that the construction is being carried out on land owned by it without the LDA, district administration, or state govt obtaining the institution’s consent or initiating any acquisition process.
Hearing the petition on Feb 27, the court had ordered for the measurement of the land in question by SDM Sadar in the presence of govt officials and representatives of the College and submit a report to the court.During the hearing on Monday, the college authorities presented a letter sent by LDA vice-chairman to the chief secretary, who is also the ex-officio senior trustee of the Lucknow Martiniere Charities, on Feb 27 seeking consent to construct nine pillars on the college’s land. When the court asked the state lawyer about the measurement, he replied that no measurement process had yet been initiated.The court hence ordered the district magistrate to appear before it and explain the non-compliance. The court also stated that contempt proceedings would be initiated after hearing administration’s explanation.
