Elon Musk and OpenAI have a long-standing legal fued and the latest is part of his statement which accuses ChatGPT of being unsafe.
Elon Musk and Sam Altman continue their legal feud
Elon Musk is once again going after OpenAI over its supposed lack of safety and making an unsafe AI chatbot in the form ChatGPT. He also mentions in the same instance that GrokAI is much safer than what OpenAI has dished out to billions in the last year. Musk made this comparison and also cited details which links ChatGPT to alleged death of some users, while Grok AI, the AI chatbot developed by his company xAI, has a cleaner record in terms of such cases.
These statements are part of an ongoing legal tussle between Musk and OpenAI and were made during a video testimony, as quoted by TechCrunch in a report.
The AI Legal Battle Continues
The legal case from Musk claims xAI and not OpenAI is more safety-focused, which is why the testimony clearly focuses on the safety part of AI chatbots with ChatGPT in the spotlight. He has also said that OpenAI’s transition from being a nonprofit research lab to a for-profit company with a valuation in billions, violates the original purpose and focus of the AI giant.
The point to highlight OpenAI’s shift is also linked to its urgent need to increase revenue streams which already includes having ads in ChatGPT for users. To be fair, it is quite rich for Musk to say OpenAI is making unsafe AI models, when GrokAI is culprit of generating explicit images of people without any control and letting people invade the privacy of innocent users.
Musk and Sam Altman, who have had a series of bitter public exchanges over the recent months amid an escalating legal battle, were once colleagues who founded OpenAI together. A friendship between the two again seems “less likely”, said Altman in a recent interview.
Back in September 2025, Elon Musk’s AI startup sued rival OpenAI in California federal court over alleged theft of its trade secrets to gain an unfair advantage in the race to develop artificial intelligence technology. Going by the slew of clashes between Musk and Altman, this won’t be the last time when the AI giants go loggerheads to claim supremacy over one another.
