New Delhi: A Delhi court dismissed the bail plea of a man accused of raping a woman on the pretext of marrying her after divorcing his wife.The court of additional sessions judge Ravindra Kumar Pandey on July 21 said that the allegations against the accused were serious and the possibility of tampering with evidence or threatening the witnesses could not be ruled out.“Hence, considering the totality of the facts and circumstances of the case and the submissions of both the parties, the court is of the view that the accused/applicant is not entitled to be admitted on bail. Accordingly, the second bail application of the accused/applicant stands dismissed,” said the judge while denying him bail.Advocate Rhythm Sheel Srivastava, appearing for the victim, submitted before the court that the WhatsApp chats between the accused and the victim reflected that the accused time and again induced her to obtain her consent for a sexual relationship on the false promise of marriage and false marriage. The counsel submitted that all the details regarding the incident were mentioned in the complaint and in the FIR, and there was no delay on the part of the victim to lodge the case against the accused.The judge refused to consider the plea of the accused that the victim was a major at the time of the alleged sexual relationship with him and she was aware of what she was doing. He argued that it was a consensual sexual relationship and could not be described as rape. The accused man was arrested on June 26 after the woman filed an FIR on June 25.She alleged that the accused established physical relations with her on Feb 10 for the first time and later on Feb 18 when he disclosed his marital status to her. The woman alleged that the accused has videographed and photographed the sexual encounter and threatened to circulate these. He also told her that he was not happy with his wife and wanted to divorce her. He promised to marry the woman.The prosecution told the court that initially, the accused induced the victim on the pretext of marriage and even after disclosing the fact of his marital status, he again assured the victim that he would divorce his wife and would marry the victim and entered into a forcible sexual relationship with her.
