Prayagraj: The Allahabad high court has dismissed an election petition challenging Mohibbullah Nadvi’s win as Samajwadi Party MP from Rampur, reports Rajesh Kumar Pandey.A petition filed by BJP candidate Ghanshyam Singh Lodhi was rejected by Justice Chandra Kumar Rai, citing a lack of cause of action.The BJP candidate alleged Mohibullah’s election was invalid due to “corrupt practice” under Section 123 (7) of the Representation of People Act, 1951, and improper acceptance of his nomination. He claimed Mohibullah’s name differed in his PAN card and electoral lists.On the other hand, Mohibullah filed an application under Order 7 Rule 11 of the Civil Procedure Code, seeking dismissal of the election petition for lacking cause of action.According to him, he had filed an affidavit before the Election Commission in 2024, stating that there was no commission of corrupt practices under Section 123 (7) of the Representation of People Act, 1951.The court, in its order dated Mar 31, dismissed the election petition and observed, “Considering the aforementioned facts and circumstances of the case, the application under Order 7 Rule 11 of CPC is allowed and election petition is dismissed for non-disclosure of any cause action.”
