T’puram: Proceedings to attach a Coast Guard (CG) vessel in connection with a 2007 Vizhinjam boat sinking case stalled on Monday, prompting the court-appointed amin to submit a report before the Neyyattinkara sub court on Tuesday alleging non-cooperation by CG authorities during the execution of the court order.Court amin Ratheesh Kumar said he was unable to execute the attachment order after he was denied access to the wharf where the vessel was berthed. According to him, the security gate leading to the wharf was not opened despite his arrival to carry out the court’s order. He said he later visited the CG office to serve the attachment order, but no official accepted it.“I will submit a report before the court detailing the developments and seek further directions. Since the execution proceedings could not be completed, I will also request the court to implead CG authorities in the proceedings,” Kumar said.This was the second unsuccessful attempt to execute the attachment order. On Saturday, the amin had reached the CG station to carry out the proceedings but returned after he was informed that the senior officials concerned were unavailable.The attachment proceedings stem from an execution petition filed by Paniyadima J, a fisherman from Pallithura in Vizhinjam, after the compensation awarded to him by the Neyyattinkara sub court remained unpaid.The case dates back to Nov 7, 2007, when Paniyadima’s fishing boat, Annai Devadanam, allegedly sank after colliding with the vessel C-34 off the Vizhinjam coast. According to the petition, the fishing boat was preparing to leave for sea when the CG vessel, while reversing during a patrol manoeuvre, struck it, causing the boat to sink and resulting in substantial financial losses.Paniyadima later approached the sub court seeking around Rs 30 lakh as compensation. The court ruled in his favour and, with accrued interest, the amount payable has risen to around Rs 41 lakh, he said. Alleging that the decree remained unimplemented despite repeated efforts, he filed an execution petition seeking attachment of the CG vessel.“Coast Guard is not cooperating with the execution of the court’s order and is unnecessarily delaying the proceedings. I have been pursuing this case for years only to secure the compensation awarded by the court,” Paniyadima alleged.Neyyattinkara sub court is expected to consider the amin’s report on Tuesday and decide the next course of action in the execution proceedings.
